Why ERISA preemption matters
💘 ERISA Pre-Emption is my Valentine (along with my wife and daughters 💕).
Why is ERISA pre-emption so crucial in the benefits world? Just imagine if we had 50 different sets of rules for 50 states or hundreds of rules for each municipality. Who could figure out how to run a business across a county, never mind the country?
1️⃣ The Employee Retirement Income Security Act of 1974, or ERISA, plays a huge role in safeguarding employee benefits. It sets the rules for minimum standards in employee benefit plans, ensuring these plans are managed with the participants' best interests in mind. ERISA covers the basics: how information is shared, the responsibilities of those managing the plans, how benefits are handled, and the rights of the beneficiaries.
🗺 NABIP stands strong behind ERISA's pre-emption. This is because having one set of federal rules, instead of a patchwork of different state laws, keeps things consistent and clear across the country. It's all about ensuring a smooth, fair, and effective management of employee benefits everywhere.
❓ So, here's a question to ponder: Wouldn't it be crazy to disrupt this system? Does anyone think the patchwork of municipal, state, and federal laws in areas like paid and unpaid leave is a good thing?

As ERISA turns 50 this year, there's a renewed focus on the law. We want to make sure that critical functions, like pre-emption, are not weakened so that national employers can offer a single benefit offering to their entire staff.
